Jooki EU Privacy Policy

This privacy policy (“Privacy Policy”) applies to the information collection and use practices of Muuselabs SA/NV (“Jooki”) regarding Jooki’s online and mobile services and devices, which are made available to you by Jooki or on its behalf through a variety of platforms, such as any website on which this Privacy Policy appears, including  eu.jooki.com, any application (“App”), and any social media pages or sites operated by or on behalf of Jooki (the “Sites”), all collectively, the “Services”. Please note that apps, sites, services and devices provided by Jooki’s US subsidiary Jooki Inc.are the subject of a separate privacy policy.

This Privacy Policy sets forth what personal and usage information Jooki collects through the Services, as well as how that information is used, maintained, and in some cases, shared with third parties. This Privacy Policy also sets forth how to contact Jooki if you have any questions about the privacy of your information. 

Please read this Privacy Policy carefully to understand Jooki’s practices regarding your information and how Jooki will treat it. By visiting, downloading, accessing, installing and/or using any part of the Services, you acknowledge that you are expressly accepting and consenting to the practices and policies outlined in this Privacy Policy. If you do not agree to these terms, then do not download, access, install or use any part of the Services. We encourage you to read the Privacy Policy, and to use the information it contains to help you make informed decisions.

This Privacy Policy applies only to information that you provide to Jooki while visiting or using the Services and does not apply to any information that Jooki has received, obtained or may obtain through third parties, offline or through other means, or any third parties which may obtain information about you from the Services. If you enter or choose to leave the Services via links to other non-Jooki websites or apps, your visits and actions on those websites and apps are not covered by this Privacy Policy. This Privacy Policy does not address the privacy practices of any third parties that we do not own, control, or are affiliated with. Capitalized terms not defined in this Privacy Policy will have the meaning set forth in our Terms of Use.

 

General provisions and definitions

In the framework of this Privacy Policy, “Personal Data” means any information relating to an identified or identifiable natural person (an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person).

“Data Protection Legislation” means Regulation (EU) 2016/679 of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation – “GDPR”), as well as any delegated act in relation to the GDPR and national laws and decrees executing the GDPR.

This Privacy Policy explains what and how Jooki collects, processes, uses, stores and protects, and in some cases, shares with third parties, certain Personal Data and usage data related to you when you use the Services as further described in the Terms of Use.

This Privacy Policy is accessible on Jooki’s websites and via the App.

Who is the Data Controller?

The legal entity responsible for the processing of your Personal Data is Muuselabs SA/NV, a limited liability company incorporated and existing under the laws of Belgium, with registered offices at Avenue Jules Bordet 13, 1140 Brussels, Belgium and registered with the Crossroads bank for enterprises under company number 0597.763.785 (“Jooki”). This Privacy Policy sets out the conditions under which Jooki, as data controller under the Data Protection Legislation may process your Personal Data. 

Please also note that some Personal Data can be collected by Jooki through a smartphone. You acknowledge and agree that (i) Personal Data may be collected and processed by the manufacturer of the smartphone and provider of your cellular services, each as data controller for its own respective purposes, under the terms and conditions of each’s own separate privacy policy, as the case may be; (ii) such manufacturer and/or cellular service provide is exclusively responsible regarding such collection and processing; and (iii) Jooki shall not be liable to you in relation to such manufacturer’s and/or cellular service provider’s processing of Personal Data.

Does Jooki Collect Any Information About Users Under Age 18?

Jooki does not knowingly solicit or collect information from anyone under the age of thirteen (13) and although the Jooki player may be used by children as young as 3, the Services are directed at persons 18 years of age or older. If you are under the age of eighteen (18), please do not attempt to register for an Account or provide any Personal Data to Jooki. If you are under the age of eighteen (18), you may only use the Services with the consent of your parent(s) or legal guardian. If you are the parent or guardian of a child under the age of eighteen (18), or the legal age of contract majority, and have authorized your child to use a Jooki player, or your mobile device, computer or provided a mobile device to such child, Jooki urges you to instruct your child never to give out his or her real name, address, phone number, email address or other personally identifying information while using the Services. Jooki recommends that the Internet browsing behavior of any child should be carefully supervised by a responsible adult at all times. There are no applications or devices in the Services which allow for the verification of your age. All information used to create an Account will be treated the same as information given by an adult.

If Jooki discovers that Personal Data of a child under 13 has been collected without parental or guardian consent, Jooki will take reasonable steps to delete such Personal Data, which may require Jooki to delete the child’s account or App access. If you are a parent or guardian of a child under the age of 13 and become aware that your child has provided Personal Data to Jooki without your authorization and consent, please contact us at privacy@jooki.com with the subject line “Personal Data/Children.”

What Jooki Collects, Why and on What Legal Basis?

To enhance the content contained on or in the Services, Jooki may gather and store certain general information about your visit or use. “General Information” is information about you or your activities through which you cannot be identified. 

Jooki collects this General Information and may use it to generate generic or aggregate statistics about visitors to and users of the Services. In situations where it is possible to do so, General Information may be linked to Personal Data.

Providing your Personal Data to Jooki is your choice.  Jooki maintains one or more databases to store your Personal Data.

To participate in the various services provided on or in the Services, Jooki asks for Personal Data, which may include your full name, address, payment information, phone number(s), and email address(es). Jooki also may collect other information, your first name (no last name), city and/or state, and country, which Jooki considers Personal Data only if combined with any of the items of Personal Data listed in the first sentence of this Section. 

The below chart sets forth what information (General Information and Personal Data) Jooki collects, how it is collected and why. It also specifies the legal basis on which Jooki relies to process your Personal Data.

The legal basis for the processing of Personal Data are, depending on the type of processing:

  • the necessity for the performance of a contract to which you are party to or the performance of pre-contractual measures taken at your request (in particular, processing that is necessary for the purchase of Jooki products and to perform the Services) (“LB1”);
  • the necessity for legitimate interests pursued by Jooki, where such interests are not overridden by your interests or fundamental rights and freedoms which require protection of personal data (namely the provision of optimal Services for the users, in order to meet the needs of these users, manage their requests and improve the Services as well as ensure the integrity of the processing, learn the habits of Jooki users in order to better advertise for its products or services and improve the Services, without impeding their rights and fundamental freedoms) (“LB2”);
  • your consent (in particular with respect to the processing for marketing purposes as the case may be, as specified below) (“LB3”); and
  • the necessity to comply with a legal obligation to which Jooki is subject (“LB4”).

Device Data

Once your Jooki player is turned on, Jooki collects data from it, including: Jooki player version, controller device type, controller operating system, software version, content source (internal or streaming), information about Wi-Fi antennas, battery state and audio settings (such as volume), and error information

·         To help ensure that your Jooki player is working properly (LB2)

·         To provide you with customer support (LB2)

·         To provide information to and teach our customer support representatives (LB2)

Usage Data

Performance Data – Jooki collects performance usage information from the Services, including: Wi-Fi information (such as signal strength, SSID), information on how often you use the App versus other control mechanisms, flow of interactions within the App, how often you use the Jooki characters and physical controls on the Jooki player, location data when the App is in use, flower of interactions with the App, and duration of usage of the Jooki player and/or the App

Activity Data – Jooki collects activity usage information from the Jooki player and the App, including: duration of music play, music service usage information, command information (such as play, pause, change volume or skip tracks), information about tracks and playlists as well as Spotify and/or Deezer user name and access token, and the Jooki player and/or App playlist

·         To help ensure that the Services are functioning properly (LB2)

·         To help predict issues with the Services (LB2)

·         For improvement to the Services (LB2)

·         To meet contractual requirements (for example, usage of third-party music services such as Spotify requires that activity information be shared with Spotify – however, activity information shared with such third parties is then subject to such third parties’ privacy policies) (LB2)

Device Diagnostics Data

In certain situations, Jooki will obtain a “Diagnostic” of your Jooki player. The Diagnostic is essentially a snapshot of everything that has been happening with your Jooki player, including: the music service being used, device configuration, volume level, Wi-Fi signal and router information, error codes, operating system, and version of the App being used with the Jooki player

User Data

Jooki collects user information, including: First Name, Last Name, Email Address, Phone Number, Social Media Identifiers (if you contact Jooki through Social Media or associate the Services with your Social Media accounts), the content of your chats, and any communications you have with customer support

·         To provide information to and teach our customer service representatives (LB2)

·         To provide warranty service under EU’s legal warranty (LB2)

·         To provide returns or refunds under the Return Policy (LB2)

User Preferences Data

Jooki collects user preference data from the Services, including playlist composition (tack titles, albums, duration, play order, etc.)

Commercial Data

Jooki collects data when you make any purchases on or through the Services, including payment information, delivery information, purchasing history, your reviews of any of the Services

Location Data

Jooki collects data regarding the location of your use of the Services, including the geographical location information regarding your Jooki player, the geographical location information regarding the mobile device on which you use the App; please note Jooki only retains aggregate information down to the level of city and does not retain precise location information

·         To provide music pursuant to applicable licenses (such as geographic restrictions for playing certain tracks) (LB1, LB2)

·         To help ensure that the Services are functioning properly (LB1, LB2)

·         To provide you with customer support (LB2)

·         To provide information and teach our customer support representatives (LB2)

·         For improvement of the Services (LB2)

            Third party data

Jooki may offer the opportunity to refer the Services to third parties. If it does so, Jooki may request and collect your referral’s first name and email address. Jooki may then send a communication to your referral with information about on how to purchase and/or sign-up for the Services. By providing Personal Data about any third party (such as referrals), you warrant that you have (i) obtained their prior consent, (ii) informed them of the existence of this Privacy Policy and (iii) secured all the necessary permissions to disclose such Personal Data and allow it to be used by Jooki for the relevant purposes.

            Payment and Service Information

If you choose to make a purchase or subscribe to a feature or service that requires a fee, or payment or payment distribution, you will be required to provide Jooki with your payment information, including credit card, bank account, or debit card numbers, account details, and similar information. This payment information will be collected, processed, and stored by Jooki’s third-party payment service provider Shopify pursuant to the terms and conditions of its privacy policy, terms of use, or any other applicable policies. In addition, MaxMind, a fraud detection service that processes Personal Data to provide Jooki with risk scores to help us avoid fraudulent transactions, also processes Personal Data as specified in its privacy policy.  Jooki does not obtain access to any payment information in connection with such purchases, provision of services, or subscriptions, nor does it store any such information. By providing your payment information, you acknowledge and agree to the use of such information by Jooki’s third-party payment service provider for the purposes of processing, receiving, or providing payments.

             Social Media

The Services may include social media features, including links to share, post or link Jooki’s content through your accounts with third party social media services. If you choose to interact with social media features on or from the Services, or if you are logged in to your social media accounts while using the Services, social media services may collect information about your use of the Services. Information collected by third party social media services is governed by the privacy policies of those third parties, not Jooki.

Jooki may collect your social media username or ID, social media plug-in information, and URL clickstream to, through and from the Services (including date and time). Information collected by social media sites may include names, titles or descriptions of videos or content viewed through your use of the Services. Your use of the Services and any third-party social media services constitutes your agreement and consent to the collection and use of information about the videos and content you view through the Services.

             Location Data

Location data, as specified in the chart above, may be collected from your use of the Services. The App requires the location service of the phone only when setting up Wi-Fi. You can disable the location service after setup if desired. The IP address and city of the App and Jooki player are collected to facilitate the connection between them and for support.

By using a Jooki player and/or authorizing the App to access your device’s location data, which you can do in your mobile device’s settings, you consent to the collection of such location data for the purposes set forth in the chart above. Location data will not be processed for longer than necessary for such purposes and will not be processed for purposes other than those specified in this Privacy Policy.

You can withdraw your consent to the processing of your location data by disabling the geolocation function on your mobile device. PLEASE NOTE HOWEVER THAT DEACTIVATING LOCATION DATA WILL SIGNIFICANTLY AFFECT THE CORRECT PROVISION OF THE SERVICES AND/OR THE EFFICIENCY OF THE APP WITH RESPECT TO THOSE FUNCTIONALITIES BASED ON LOCATION AND/OR MAY SEVERELY IMPEDE THE PURPOSE OF THE APP.

At this time, you CANNOT disable the collection and processing of location data from the Jooki player.

             Third Party Advertising

At this time, Jooki does not collect information about your activity on the Services to be shared with third parties for advertising purposes. Jooki also does not allow third parties to collect information about your activity on the Services to be used for third party advertising purposes. Please note, social media services may have their own third-party advertising which is generated from or uses your Personal Data. If you are logged into your social media account while accessing or using the Services, such social media services may serve you third-party advertisements. Such third-party advertisements are governed by the policies of the applicable social media service, not Jooki.

             Third Party Analytics

Jooki and the third-party technology service providers, ad exchanges, ad networks, advertisers, agencies, and ad servers Jooki works with may use third-party analytics services to evaluate your use of the Services, compile reports on activity, collect demographic data, analyze performance metrics, and collect and evaluate other information relating to the Services, the Jooki player, and mobile and Internet usage. These third parties use cookies and other technologies to help analyze and provide Jooki such data.

The cookies used do not collect any data that may lead to an identification of the users. All information collected with the aid of such cookies exclusively serves the purpose of understanding and improving the functionality of the Services. The information regarding your use of the Services generated by the use of Google Analytics is usually transmitted to and stored on a Google server in the USA. However, the code “gat._anonymizeIp();” has been added to ensure anonymous recording of IP addresses, known as “IP masking”. Google IP address anonymization on the Services truncates your IP address within the European Union and European Economic Area territories. Only in exceptional cases will the full IP address be sent to a Google server in the USA and truncated there. The IP address transmitted as part of Google Analytics is not merged with other Google data. You may opt out of these third-party cookies by setting your Cookie Choices in the pop-up window.

            

How Does Jooki Collect Information?

In addition to the chart above, your information is collected from the Services, through email and/or through online applications or forms you complete, registration, requests for Jooki or information about the Services, entering sweepstakes or prize promotions, taking surveys, reporting problems, information you volunteer to Jooki, and through any of your other activities with Jooki.  The Personal Data that Jooki collects depends on the nature of your activities.

How Does Jooki Use the Information Jooki Collects?

Personal Data you volunteer is used by Jooki for internal verification, to complete requested transactions, to obtain and deliver the requested products, to ensure appropriate legal use of the Services, to provide you notification about updates to the Services, and to help provide you with technical support for the Services (LB1, LB2).

Specifically, Jooki uses the information it collects about you as follows:

  1. As set forth in the chart above;
  2. To notify you of changes to the Services or any of Jooki’s agreements, terms and policies with respect or related to the Services, including this Privacy Policy (LB1, LB2);
  3. To solicit your feedback about the Services (LB2);
  4. To communicate with you regarding messages you send us from within the Contact Us form (LB2, LB3);
  5. To deliver goods or services you request, purchase or subscribe for (LB1);
  6. To enable Jooki to provide, improve and maintain the Services, including administration and internal operations such as data usage and analysis, research, testing, and troubleshooting (LB2);
  7. To help keep the Services safe and secure (LB2);
  8. To administer promotional programs (LB2); and
  9. To comply with administrative, regulatory and legal requirements (LB4).

To the greatest extent commercially possible, Jooki shall process aggregate data (which is data that neither identifies you nor can be linked to you, such as statistic data), pseudonymized or anonymized data, rather than Personal Data, when the purposes of such processing can be achieved in the same way.

Jooki may anonymize Personal Data and share it in an aggregated form with third parties, advertisers and/or business partners in order to analyze the Services, improve the Services and user experience, or for other similar purposes. The use and disclosure of such anonymous information is not subject to any restrictions under this Privacy Policy.

How Does Jooki Share Your Information with Third Parties?

Jooki does not share your Personal Data with any third parties, except as described in this Privacy Policy.

Jooki shares information about you, including your Personal Data, with the following third parties:

  1. Jooki’s service providers, which are business partners, suppliers and subcontractors that assist Jooki in providing and maintaining the Services. For example, Jooki may use companies to help provide products or services, like a shipping company that may deliver packages, an email company that may deliver our newsletters, a financial partner that assists in the completion of transactions you request or provide, a help desk partner that provides or assists with customer support, a third-party fulfillment company to administer prize promotions, a data processor, or any other third party that is needed to assist in the completion of transactions or the provision of goods or services you request or provide;
  2. Service providers and business partners who supplement information Jooki collects with additional information about visitors or users of the Services and who help Jooki better connect with Jooki’s intended audience;
  3. Analytics and search engine providers that aid Jooki in the improvement and optimization of the Services;
  4. Any of Jooki’s subsidiaries, joint ventures, or other companies under common control with Jooki; and
  5. To any other third party with your consent to do so.

Jooki may also disclose your Personal Data:

  1. To comply with any applicable law or legal process, including in response to judicial, administrative, or governmental subpoenas, warrants or orders served on Jooki;
  2. When Jooki believes it is necessary to protect and defend Jooki’s rights or property, to enforce the provisions of this Privacy Policy and/or any other Jooki terms and conditions, policies or agreements (including our Terms of Use), to guard against fraud, and/or to prevent harm to Jooki, its members and any other person or entity;
  3. In the event of a change of ownership, corporate sale, acquisition, merger, reorganization, sale of assets, or dissolution or similar event; or
  4. If Jooki becomes subject to an order of appointment of a trustee in bankruptcy or receiver.

To the extent that this involves the transfer of Personal Data to countries outside of the European Economic Area that would not be considered by the European Commission as ensuring an adequate level of personal data protection, Jooki shall ensure that appropriate contractual measures are put in place in accordance with the Personal Data Legislation. A copy of those appropriate contractual measures can be provided upon request by sending an email to privacy@jooki.com.

Jooki reserves the right to release and/or use all information contained within Jooki’s databases, access logs or other records concerning you, including your Personal Data, if you violate this Privacy Policy, the Terms of Use, or any Jooki terms and conditions, or other rules, policies, notices, agreements or guidelines, or if you intentionally or unintentionally partake (or are reasonably suspected of partaking) in any illegal activity, including but not limited to hacking, even without a subpoena, warrant or other court order, and to release such information in response to court and governmental orders, civil subpoenas, discovery requests and as otherwise required by law and/or to initiate Jooki’s own legal proceedings. Jooki cooperates with law enforcement agencies in identifying those who may be using the Services (or any part thereof) for illegal activities. Jooki also reserves the right to report any suspected illegal activity to law enforcement individuals or to entities for investigation or prosecution.

What About Information Shared on Community Services?

Jooki may make message boards, blogs, reviews, allow comments and provide other community services available to you on the Services. Please understand that any information that is disclosed by you in these areas becomes public information. When you disclose such information in a comment or on message board, blog, review or any other public forum, you do so at your own risk. Jooki has no control over its use and you should exercise caution when deciding to disclose your Personal Data or any other information about yourself. The information presented in these areas reflects the views of the individual users, providers or hosts and does not necessarily reflect the views of Jooki. Jooki reserves the right (but has no obligation) to monitor the use of message boards, blogs, reviews or other public forums on the Services.

Does Jooki Use De-Identified Information?

Jooki may take your Personal Data and make it non-personally identifiable, either by combining it with information about other individuals (aggregating your information with information about other individuals), or by removing characteristics (such as your name) that make the information personally identifiable to you (de-personalizing your information). Given the nature of this information, there are no restrictions under this Privacy Policy upon the right of Jooki to aggregate or de-personalize your Personal Data, and Jooki may use and/or share with third parties the resulting non-personally identifiable information in any manner in Jooki’s sole discretion.

How Does Jooki Maintain and Secure the Personal Data Jooki Collects?

Jooki takes commercially reasonable measures to protect the security and confidentiality of your Personal Data, including measures to protect against accidental or unauthorized destruction, loss as well as illicit or unauthorized modification, use, access and other processing. These security measures include, for example, internal reviews of Jooki’s data collection, storage and processing practices and security measures, as well as physical security measures to guard against unauthorized access to systems where Jooki stores Personal Data.

When the use of the Services involves the transmission of Personal Data, Jooki may use Transport Layer Security (“TLS”) technology to establish a secure connection between your Jooki player, computer or mobile device and Jooki and/or the Services. Jooki may also allow the transmission of encrypted information from your Jooki player, computer or mobile device to Jooki and/or the Services and back again.

Jooki reserves the right to monitor all network and other traffic to and in the Services to identify and/or block unauthorized attempts or intrusions to upload or change information or cause damage to any of the Services in any manner.

Please be aware that no data transmission over the Internet or which is stored on a Jooki player, computer or mobile device connected to the Internet can be guaranteed to be 100% secure, so while Jooki strives to protect your Personal Data, Jooki cannot ensure or warrant the security of any information that you voluntarily give to us.

What are my rights and how can I exercise them? Can My Personal Data be Corrected or Deleted?

You have the right to access to your Personal Data, as collected and processed by Jooki, and to request their rectification or erasure (as the case may be) in the event that they would be inaccurate or unnecessary. You have the right to restriction of processing or to object to the processing as well as the right to data portability.

Most of the Personal Data you provided us with can be directly accessed, erased and rectified by navigating on the App or your Account.

Otherwise, in order to exercise your rights, you only have to send a written and signed request to Jooki at the email address privacy@jooki.com or at the postal address Muuselabs SA/NV, Avenue Jules Bordet 13, 1140 Brussels, Belgium, together with a document proving that you are the data subject of the relevant Personal Data.

In general, you also have the right to withdraw your consent to any processing at any time. This includes your right to withdraw consent to our use of your Personal Data for direct marketing purposes. This withdrawal of consent does not affect the lawfulness of the processing based on consent made prior to such withdrawal.

You should be aware that you cannot opt-out of receiving transaction related communications, including regarding purchases, provision of the Services, and customer support.

If you consider that the processing of your Personal Data constitutes a violation of Data Protection Legislation, you have the right to lodge a complaint with a supervisory authority, in particular in the Member State of the European Union of your usual place of residence or any other applicable jurisdiction, your place of work or the place where the violation occurred.

How Long Does Jooki Retain Personal Data?

Jooki maintains your information for no longer than necessary for the purposes for which it was collected and is processed. Thus, the length of time that Jooki retains your information depends on the purposes for which it was collected and used and/or as is required to comply with applicable laws. For instance, your Account data will be kept as long as you have an Account and for a period of maximum six months following the suppression of your Account and Personal Data relating to purchases will be kept for the duration of the legal retention periods for accounting purposes (unless Jooki has a specific legitimate interest in storing your Personal Data for a longer period, e.g. to the extent the data is required to clarify an alleged infringement of third party rights, to resolve a dispute, or to comply with a legal obligation). Users action on Jooki products will be kept for a maximum period of six months. Wi-Fi  information is kept until the Jooki player is reset.

Any Personal Data which is contained in Jooki’s or any of its subprocessor’s regular backups will not be deleted, provided that any such Personal Data shall remain subject to the confidentiality and data privacy and security terms and conditions of this Privacy Policy until destroyed.

Does Jooki Use Cookies?

When you visit or use the Services, Jooki may place a cookie in a file directory on your computer or mobile device. A cookie is a small text file that is placed on your computer or mobile device to uniquely distinguish your visit to a website or use of an online service or mobile application. The information that cookies collect includes the date and time of your visit and your registration information. Cookies may offer you many conveniences for the Services and allow Jooki to recognize certain information, such as your browser type, so Jooki knows if you can view certain plug-ins or extensions. They also allow Jooki to streamline your visit to and usage of the Services based on your previous visits and usage.

Cookies may be either permanent or temporary. Jooki may use both temporary and permanent cookies, as may be detailed in the website “cookie banner”. A temporary or “session” cookie is placed on your computer or mobile device during your visit to certain of the Services and is deleted when you exit your Internet browser, close the App and/or turn off your computer or mobile device. A permanent or “persistent” cookie means that the cookie stays on your hard drive or mobile device until you delete it. You can delete Jooki’s permanent cookie at any time by following the instructions contained in your browser’s help file, or by contacting the company providing your browser’s or mobile device’s technical support. Jooki does not use cookies to store information such as credit card numbers, social security numbers or any other highly sensitive Personal Data.

When you visit the Jooki website for the first time, information on privacy and wording regarding the consent to the use of cookies will appear through a “cookie banner”. In addition to necessary cookies, you will be presented the opportunity to also select performance, functional and/or targeting cookies by clicking on “Cookies settings”. By default, only necessary cookies will be selected. By clicking on “+”, you will have access to the following information in relation to each cookie: name, provider, purpose, expiry and type.

Your cookies selection will be stored in your browser, so that the information of the “cookie banner” does not have to be repeated on every page of the website or at your next connection. In the event that your consent would no longer be registered in your browser (e.g. in case of suppression of the cookies), the “cookie banner” will appear again the next time you visit the website.

Jooki installs and uses certain technically required cookies on your device which do not require your prior consent. Other cookies (such as cookies to improve the navigational experience by keeping record of certain data (this avoids you having to reintroduce such data at each connection) and by tailoring the content of the website to your preferences) may be installed and used on the basis of your consent.

You may also configure your browser or device to accept or deny cookies from the Services. However, opting out, disabling or denying cookies from the Services may render parts of the Services inaccessible or may cause certain web pages or parts of the App not to properly load. There are also several services and websites which allow you to visit websites, including the Services, anonymously. Again, you may not be able to access or use all of the content or services available on or in the Services if you use these anonymizing services or websites. If you change computers or browsers or devices or use multiple computers or browsers or devices or delete Jooki’s cookies, you will need to repeat this process for each computer, each browser, and each device.

Does Jooki Use Web Beacons/Pixel Tags?

Jooki may use “Web Beacons,” sometimes referred to as “pixels,” “clear gifs,” or “web bugs”, which are another way (instead of cookies) of helping to personalize your experience on or in the Services. Web Beacons are typically invisible to you and are generally embedded in very small clear graphics files. “Pixel Tags” are small strings of computer code that provide a method for delivering a graphic image on a web page or other medium. Pixel Tags allow Jooki or a third party who serves the Pixel Tag, to set, read, and modify some of Jooki’s cookies.

Jooki may use Web Beacons and Pixel Tags to monitor certain non-personally identifiable information about you, including the URL of the page from which the Web Beacon or Pixel Tag originated, the type of browser used, the IP address of your computer and the time you viewed the Web Beacon or Pixel Tag. While Web Beacons and Pixel Tags do not collect Personal Data, the information collected by them may be used in conjunction with cookies to identify aggregate information about users of the Services.

What Happens with Do Not Track Requests?

Jooki does not currently have the capabilities to recognize the Do Not Track signals, settings or mechanisms, including from any Internet browsers. Therefore, any selection you make within your Internet browser will not be applied to the Services. For more information regarding Do Not Track you can visit www.allaboutdnt.org.

Links or Usage of Third-Party Websites or Apps/App Stores

The Services may contain links to third-party websites or apps. Jooki has no control over the privacy practices or the content of such third-party websites. You acknowledge and agree that neither Jooki, nor any of its officers, directors, partners, employees, agents, representatives, vendors or suppliers are responsible for the content, privacy policies, products, services, reliability, viewpoint or accuracy of information on any such websites or apps. Jooki does not control and is not responsible for the collection of Personal Data by third party websites or apps or any websites or apps not controlled by Jooki.

The app stores (e.g., App Store or Google Play) may collect certain information in connection with your use of the Services, including Personal Data, geolocational information, payment information, and other usage-based data. Jooki has no control over the collection of such information by any third-party app store, and any such collection or use will be subject to such third-party app store’s applicable privacy policy.

Governing Law/Jurisdiction

All Disputes are governed by the terms set forth in Jooki’s Terms of Use.

If you are accessing the Services from any location with regulations or laws governing personal data collection, use or disclosure that differ from EU’s General Data Protection Regulation (GDPR), please note that through your continued use of the Services, which are governed by the laws of Belgium and this Privacy Policy, you are transferring Personal Data to the European Union.

Opt-Out of Jooki Communications/Notifications

You may choose to opt-out of receiving electronic communications from Jooki at any time and without having to provide any justification. To opt-out of non-transactional electronic communications from Jooki, please contact Jooki at opt-out@jooki.com (subject line: “Opt-Out Email Communications”) to request that you be unsubscribed from any of Jooki’s marketing emails. You must provide your name and email address(es) when making any such request. In addition, you may manage your receipt of marketing and non-transactional communications by clicking on the “unsubscribe” link located on the bottom of any such communication. Jooki will use commercially reasonable efforts to process such requests in a timely manner.

Jooki may also deliver notifications to your mobile device (i.e., push notifications). You can disable these notifications by deleting the applicable app or by changing the settings on your mobile device.

You should be aware that you cannot opt-out of receiving transaction related communications, including regarding provision of services and customer support.

Changes to this Privacy Policy

Jooki reserves the right to make changes to any terms of this Privacy Policy at any time, however, Jooki shall provide notification to you in advance of any changes becoming effective, such as by posting a notification on or in the Services, in the App, or via email if you have provided Jooki with your email address. If you continue to access and/or use any of the Services after the effective date of such changes, then such access and/or use will be deemed an acknowledgment of the revised Privacy Policy. The revised Privacy Policy supersedes all previous notices or statements regarding the Services. For this reason, Jooki encourages you to review this Privacy Policy any time you access or use the Services, and Jooki recommends that you print out a copy for your records.
